TERMS AND CONDITIONS OF SALE AND USE FOR JAPANPOPMART SITE

ARTICLE 1: DEFINITIONS

  • Client: Any person, natural or legal, private or public entity, registered on the Site to purchase Products.
  • Site Content: All elements published on the Site, such as text, images, videos, designs, databases, and software, whether or not protected by intellectual property rights.
  • Publisher: Japanpopmart, the publisher of the Site.
  • Visitor: Any person, natural or legal, accessing the Site without necessarily being a Client.
  • Product: Any goods sold on the Site by the Publisher to the Client.
  • Site: The website www.japanpopmart.com, including all sub-sites and portals.

ARTICLE 2: SCOPE

Access to the Site is free of charge. Any Visitor browsing the Site agrees to these terms and conditions. Acceptance of these terms is confirmed upon registration by checking the appropriate box, serving as an electronic signature and proof in the event of a dispute.

Visitors must have legal capacity to accept these terms or be authorized by a legal representative (if a minor or under guardianship).

ARTICLE 3: PURPOSE OF THE SITE

The Site is intended for the sale of Products to international Clients.

ARTICLE 4: ORDERING

4.1. Product Selection
Clients can select one or more Products by adding them to their cart. Product availability is indicated on the Site. Once finished with their selection, Clients can access their cart to place the order.

4.2. Order Validation
After viewing their cart, Clients can verify and modify their selection before confirming their order by signing in or creating an account.

4.3. Payment
Clients will be prompted to make their payment through a secure interface. Once payment is completed, the Publisher confirms the order via email within 48 hours.

4.4. Order Confirmation
The Publisher will send an email confirmation including an order summary.

ARTICLE 5: PRICING AND PAYMENT

5.1. Product Prices
Prices are listed in yen and include applicable taxes. However, prices may be displayed in other currencies based on buyer preference. The client can select a preferred currency during site navigation among those offered.

5.2. Payment Methods
Product payments can be made via various methods, such as credit cards (Visa, MasterCard, American Express), electronic payment systems (PayPal, etc.), or any other payment methods specified on the site. Payment is always secure, thanks to our encryption system, ensuring the protection of confidential information.

5.3. Currency Conversion
When the buyer chooses a currency other than the default, the total order amount will be automatically converted at the exchange rate in effect at the transaction time. The final amount may vary depending on the conversion fees applied by the buyer’s bank or selected payment provider.

5.4. Payment Terms
Full payment is required at order confirmation. If payment authorization is declined by banking institutions, the order will be canceled, and the buyer will be notified immediately.

5.5. Taxes and Customs Duties
Depending on the buyer’s country of residence and chosen currency, additional taxes or customs duties may apply locally and are the buyer’s responsibility. It is recommended to check local conditions before placing an order.

5.6. Specific Clause – Shipments to the United States (2025 regulations)
Due to the termination of the U.S. “de minimis” regime (Executive Order, July 2025, under Section 321 of the Tariff Act – 19 U.S.C. §1321) and Japan Post’s updated acceptance rules, some shipments may be refused, held, inspected, or delayed by U.S. Customs authorities.
JapanPopMart.com cannot be held responsible for delays, refusals, or returns caused by these regulations beyond our control. However, we commit to providing tracking, assisting the customer with claims, and applying our internal replacement/refund policy if delivery becomes impossible.

ARTICLE 6: PUBLISHER LIABILITY

6.1. Best Efforts Obligation
The Publisher commits to providing Products according to the descriptions on the Site and guaranteeing their quality.

6.2. Force Majeure
The Publisher shall not be held liable in cases of force majeure (natural disasters, strikes, war, etc.) that prevent fulfilling obligations.

6.3. Client’s Fault
The Publisher cannot be held liable in the case of improper use of the Site or Products by the Client.

6.4. Hyperlinks
The Site may contain links to other sites, but the Publisher is not responsible for the content of these third-party sites.

ARTICLE 7: APPLICABLE LAW AND DISPUTES

These terms are governed by Japanese law. In case of a dispute, the parties agree to seek an amicable solution before taking legal action. If unsuccessful, the competent court will be that of the Publisher’s address jurisdiction.

ARTICLE 8: MODIFICATIONS TO THE TERMS AND CONDITIONS

The Publisher reserves the right to modify these terms and conditions at any time.
