JAPANPOPMART TERMS AND CONDITIONS OF SALE AND USE

Effective as of September 7, 2026

ARTICLE 1: DEFINITIONS

Customer: any individual or legal entity that places an order on the Website.
Website Content: all elements published on the Website, including texts, photographs, images, videos, graphics, logos, databases, and software.
JapanPopMart / The Seller: JapanPopMart, operator and publisher of the Website.
User: any person accessing or browsing the Website, whether or not they make a purchase.
Product: any item offered for sale on the Website by JapanPopMart.
Website: the JapanPopMart.com website and its various language or regional versions.

ARTICLE 2: SCOPE AND ACCEPTANCE

These Terms and Conditions of Sale and Use govern access to the Website and orders placed with JapanPopMart.
Access to the Website is free of charge, excluding any costs associated with the User’s internet connection.
By placing an order, the Customer acknowledges that they have read and accepted these Terms and Conditions as well as the applicable policies available on the Website.
The Customer must have the legal capacity required to enter into a contract or, where permitted by applicable law, act with the authorization of their legal representative.
These Terms and Conditions apply subject to any mandatory consumer rights available to the Customer under the applicable laws of their country of residence.

ARTICLE 3: PURPOSE OF THE WEBSITE

JapanPopMart primarily offers trading cards and related products for sale, shipped from Japan to countries and territories served by the shipping services offered on the Website.
Product availability and available shipping methods may vary depending on the destination country.

ARTICLE 4: ORDERS

4.1 Product Selection

The Customer may select one or more Products and add them to their shopping cart.
The presence of a Product on the Website does not guarantee its permanent availability. Products are offered subject to available stock.

4.2 Order Review

Before proceeding with payment, the Customer may review the contents of their shopping cart, quantities, Product prices, applicable shipping charges, and the information provided for delivery.
The Customer is responsible for ensuring that the information provided, including their name, postal address, and contact details, is complete and accurate.

4.3 Order Validation and Payment

The order is validated after payment has been confirmed, subject to acceptance by JapanPopMart.
Payment must be made in full at the time the order is placed using one of the payment methods offered at checkout.
If payment is declined, cancelled, or cannot be confirmed, the order may be cancelled.

4.4 Order Confirmation

Once the order has been validated, a confirmation will be sent to the email address provided by the Customer.
This confirmation will contain the main information relating to the order.

4.5 Unavailability or Exceptional Cancellation

In the exceptional event that a Product becomes unavailable after an order has been validated, JapanPopMart will inform the Customer and refund the affected Product or, with the Customer’s agreement, offer an alternative solution.
JapanPopMart may also refuse or cancel an order in cases of reasonable suspicion of fraud, an obvious pricing error, a payment issue, or where applicable regulations prohibit shipment of the Product to the relevant destination.
If JapanPopMart cancels an order after payment has been collected, the amounts corresponding to the cancelled Products will be refunded to the Customer, subject to applicable legal requirements.

ARTICLE 5: PRICES, PAYMENT, TAXES, AND CUSTOMS DUTIES

5.1 Product Prices

The reference prices of Products are established in Japanese yen (JPY).
Depending on the country, language, or settings used by the Customer, the Website may also display prices in other currencies available during browsing or checkout.
The applicable price is the price displayed to the Customer when the order is confirmed.
Shipping charges are displayed separately before payment is confirmed.

5.2 Payment Methods

The payment methods available are those offered to the Customer at checkout.
Payments are processed through the systems and payment service providers used by JapanPopMart’s e-commerce platform.
JapanPopMart does not guarantee the permanent availability of any particular payment method.

5.3 Currency Conversion

When the Customer makes a purchase in a currency other than Japanese yen, currency conversion may apply.
The exchange rate and the amount actually charged may depend on the payment method, payment provider, or the Customer’s financial institution.
Additional currency conversion or banking fees may be charged independently of JapanPopMart.

5.4 Payment Terms

Full payment is required when the order is placed.
If payment is declined or unsuccessful, the order cannot be completed or may be cancelled.

5.5 Taxes, Customs Duties, and Import Charges

JapanPopMart ships its Products from Japan.
Depending on the destination country, international orders may be subject to customs duties, import taxes, customs clearance fees, collection fees, or other charges imposed upon importation.
Unless expressly stated otherwise at checkout, these charges are not included in the price of the Products or in the shipping charges paid to JapanPopMart and remain the responsibility of the recipient.
JapanPopMart does not control the amount of these charges and cannot guarantee in advance the amount that may be charged by authorities, the carrier, or the customs clearance provider.
The Customer is responsible for checking any import regulations applicable in their country before placing an order.

5.6 Special Provisions for the United States

Due to the regulations currently applicable to the importation of goods into the United States, customs duties, import taxes, customs clearance fees, collection fees, or other charges may apply to goods shipped from Japan, regardless of the value of the order.
Shipping charges paid to JapanPopMart at the time of purchase cover only the shipping service offered at checkout.
They do not include U.S. customs duties, import taxes, customs clearance fees, collection fees, or other charges that may be imposed when goods are imported into the United States.
These charges are determined by U.S. customs authorities and/or organizations responsible for customs clearance and remain the responsibility of the recipient.
JapanPopMart does not determine these charges and cannot guarantee in advance the amount, if any, that may be charged.

The recipient is responsible for:
- paying any customs duties, import taxes, and other charges that may be imposed;
- providing any additional information or documentation required for customs clearance;
- responding to any requests from the carrier, its customs clearance partner, or U.S. customs authorities.

Refusal or failure to pay customs duties, taxes, or import-related charges does not constitute cancellation of the order and does not automatically entitle the Customer to a refund.
JapanPopMart declares merchandise in accordance with the requirements applicable to international shipping and customs clearance.
The description, quantity, and value stated on customs documentation must correspond to the actual contents of the shipment.
JapanPopMart cannot, at the Customer’s request, declare a commercial order as a “gift” or “document,” nor intentionally declare an artificially reduced value for the purpose of avoiding or reducing customs duties, taxes, or other import charges.
Orders shipped to the United States are currently sent with a tracking number.
Delivery times provided when placing an order are estimates. Customs inspections, requests for additional information, customs clearance procedures, or other formalities imposed by U.S. authorities may extend the delivery time.
A shipment delayed by customs is not considered lost solely because of such a delay.
If the recipient refuses delivery, refuses or fails to pay required duties, taxes, or charges, or fails to provide information necessary for customs clearance, the shipment may be unable to be delivered.
Depending on the circumstances and the procedures of the carrier or relevant authorities, the shipment may be returned to JapanPopMart, held, abandoned, or destroyed.
If the shipment is returned to JapanPopMart, no refund will be issued until the shipment has been received and inspected by JapanPopMart.
The original shipping costs, as well as any return shipping, customs clearance, handling, or other charges actually incurred by JapanPopMart as a result of the recipient’s refusal, non-payment, or failure to cooperate, may be deducted from the refund to the extent permitted by applicable law.
Customs duties, import taxes, customs clearance fees, or other amounts paid directly by the recipient to U.S. authorities, the carrier, or a customs clearance provider are not collected by JapanPopMart and therefore cannot be refunded by JapanPopMart.
Detailed provisions regarding returns and shipments that are delayed, lost, refused, returned, or destroyed, as well as applicable refunds, are set out in the JapanPopMart Return and Refund Policy.
These provisions apply subject to any mandatory consumer rights available under applicable law.

ARTICLE 6: SHIPPING AND DELIVERY

6.1 Shipping from Japan

All orders are shipped from Japan.
Available shipping methods, rates, and estimated delivery times may depend on factors including the destination country, order value, weight, package dimensions, and available carrier services.
The applicable options are presented to the Customer at checkout.

6.2 Delivery Times

Delivery times displayed on the Website or at checkout are estimates unless expressly stated otherwise.
They may be extended due to customs inspections, customs clearance procedures, carrier disruptions, weather conditions, periods of high shipping volume, or other events beyond JapanPopMart’s reasonable control.
This provision does not affect any mandatory consumer rights relating to delivery.

6.3 Delivery Address

The Customer is responsible for providing a complete and accurate delivery address.
Additional costs actually incurred by JapanPopMart as a result of an incorrect or incomplete address provided by the Customer may remain the Customer’s responsibility where permitted by applicable law.

6.4 Tracking

A tracking number is provided when the shipping method selected or applicable to the order includes a tracking service.
Orders shipped to the United States are currently sent with a tracking number.

ARTICLE 7: PRODUCTS AND TRADING CARDS

7.1 Photographs of Individually Sold Cards

For trading cards sold individually, the card shown in the photographs on the Product page is the actual card shipped to the Customer, unless expressly stated otherwise on the Product page.
The photographs therefore allow the Customer to assess the visual condition of the card before purchasing it.

7.2 Product Condition and Presentation

JapanPopMart makes reasonable efforts to present Products and their condition as accurately as possible.
Minor differences in color or appearance may nevertheless occur depending on the screen, lighting, or device used to view the Website.
Customers are encouraged to carefully review the Product photographs and description before placing an order.
These provisions do not limit the Customer’s rights where a Product is defective, incorrect, or does not conform to the order.

ARTICLE 8: RETURNS, WITHDRAWAL, AND REFUNDS

The conditions applicable to return requests, statutory rights of withdrawal, damaged or incorrect Products, refunds, return shipping costs, and customs-related situations are set out in the JapanPopMart Return and Refund Policy available on the Website.
That policy forms an integral part of these Terms and Conditions.
Where a Customer benefits from a statutory right of withdrawal under applicable law, that right may be exercised in accordance with the applicable mandatory legal provisions.
Any restocking fee provided for in the Return and Refund Policy will not apply where such a deduction is prohibited by applicable law or where the return results from the exercise of a statutory right of withdrawal that does not permit such a deduction.

ARTICLE 9: LIABILITY

9.1 JapanPopMart’s Obligations

JapanPopMart undertakes to process orders with reasonable care and to provide Products corresponding to the information presented on the Website.
Nothing in these Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited.

9.2 Events Beyond Our Control

JapanPopMart shall not be liable for delays or failure to perform resulting from events beyond its reasonable control, including natural disasters, major transportation disruptions, conflicts, strikes, administrative decisions, regulatory changes, or other events recognized as force majeure under applicable law.
This provision does not limit any mandatory consumer rights.

9.3 Customer Error or Failure to Cooperate

JapanPopMart shall not be liable for consequences directly resulting from incorrect information provided by the Customer, refusal of delivery, failure to pay duties or taxes for which the recipient is responsible, or failure by the Customer to cooperate with formalities necessary for delivery or customs clearance, except where the issue results from an error attributable to JapanPopMart.

9.4 Links to Third-Party Websites

The Website may contain links to websites or services operated by third parties.
JapanPopMart has no control over these third-party services and is not responsible for their content, availability, or practices, subject to applicable law.

ARTICLE 10: INTELLECTUAL PROPERTY

Unless otherwise stated, content created for JapanPopMart and displayed on the Website, including texts, photographs, graphics, logos, and presentation elements, may not be reproduced, distributed, or commercially exploited without prior authorization where such content is protected by intellectual property rights.
Trademarks, names, illustrations, characters, and other elements belonging to third parties remain the property of their respective owners.
The sale by JapanPopMart of Products containing trademarks or other protected elements belonging to third parties does not imply any affiliation, endorsement, authorization, or partnership with their respective owners unless expressly stated otherwise.

ARTICLE 11: USE OF THE WEBSITE

The User agrees not to use the Website in a fraudulent or unlawful manner or in any way that could compromise its operation, security, or the rights of JapanPopMart or third parties.
In particular, Users must not attempt to gain unauthorized access to the Website’s systems, interfere with its operation, or use the Website for fraudulent purposes.
JapanPopMart may restrict or suspend access to the Website in cases of clearly abusive or fraudulent use, subject to applicable law.

ARTICLE 12: PERSONAL INFORMATION

The processing of personal information collected through use of the Website and in connection with orders is governed by the JapanPopMart Privacy Policy available on the Website.

ARTICLE 13: GOVERNING LAW AND DISPUTES

These Terms and Conditions are governed by Japanese law.
However, this choice of law does not deprive a consumer of the protection of mandatory provisions applicable under the laws of their country of residence where such provisions cannot lawfully be excluded by contract.
In the event of a dispute, the Customer and JapanPopMart are encouraged to first seek an amicable resolution.
If an amicable resolution cannot be reached, the competent court or jurisdiction will be determined in accordance with the applicable rules governing jurisdiction.
Nothing in these Terms and Conditions is intended to deprive a consumer of any right or remedy that cannot lawfully be waived.

ARTICLE 14: CHANGES TO THESE TERMS AND CONDITIONS

JapanPopMart reserves the right to amend these Terms and Conditions to reflect, among other things, legal, regulatory, customs, technical, logistical, or commercial developments.
Any changes will be published on the Website together with their effective date.
The Terms and Conditions applicable to an order are those in effect at the time the order is placed, subject to any applicable mandatory legal provisions.
